This test contains 207 real Evidence questions from past exams administered by the NCBE. All Evidence questions should be answered according to the Federal Rules of Evidence, as currently in effect. Approximately one-quarter of the Evidence questions on the MBE will be based on category I (Presentation of evidence), one-third on category II (Relevancy and reasons for excluding relevant evidence), one-quarter on category V (Hearsay and circumstances of its admissibility), and the remainder on categories III and IV (Privileges and other policy exclusions and Writings, recordings, and photographs).
