What is Exemplary Damages?

Damages awarded to a Plaintiff over and above the usual damages recognized in a breach of contract situation. These damages are not generally recognized in a breach of contract situation, however, they may in some cases and jurisdictions be applied when the facts egregiously show violence, oppression, malice, fraud or wanton and wicked conduct.
