Learn about the definition for this legal term.

What is Negligent Birth Delivery (Medical Malpractice)?

A childbirth injury that results in death or serious injury to the baby may give rise to a medical malpractice claim if the treating physician failed to provide the healthcare professional that is required under the circumstances. The child often suffers severe oxygen deprivation during a negligent delivery, which may then cause neurological damages, paralysis and other severe and permanent symptoms. Where there is permanent disability, these claims bring some of the largest monetary awards seen in the annals of medical malpractice law.
